This service allows members of the public to provide factual information about suspected illegal working. Reports are assessed and, where appropriate, may be shared with the relevant public authorities.

Purpose of this Service

The purpose of this website is to receive reports relating to suspected illegal working so that appropriate information may, where considered necessary, be passed to the relevant enforcement authorities.

Reports are treated as allegations only.

Submitting a report does not establish that any offence has occurred and no assumptions will be made about any individual or business solely because a report has been received.

What Information We Collect

Depending upon the information you choose to provide, we may collect:

• details of the business or employer concerned;
• location of the suspected activity;
• dates and times;
• a description of the work being undertaken;
• details explaining why you believe illegal working may be taking place;
• names or other identifying information where genuinely known;
• photographs, videos, documents or web links provided by you;
• whether the matter has already been reported to another authority;
• your name and contact details if you choose to provide them.

You may also choose to submit your report anonymously.

Information We Ask You Not to Provide

Unless specifically requested by a competent public authority, please do not submit:

• passport copies;
• National Insurance numbers;
• banking or financial information;
• immigration documents;
• medical records;
• information that is not directly relevant to your report.

Please only provide information necessary to explain your concerns.

Lawful Basis for Processing

We process personal information under Article 6(1)(f) UK GDPR (Legitimate Interests).

Our legitimate interests are:

• receiving reports concerning suspected illegal working;
• assessing information submitted;
• helping protect the integrity of the UK labour market;
• assisting competent public authorities where appropriate;
• preventing abuse of this reporting system.

Where reports contain information relating to alleged criminal offences, such information is handled in accordance with applicable provisions of the UK GDPR and the Data Protection Act 2018.

Accuracy

We ask reporters to provide factual information only.

Reports should be based upon genuine observations or information honestly believed to be true.

A report is not proof that unlawful activity has taken place.

Who We May Share Information With

Where appropriate, information may be shared with:

• the Home Office;
• UK police forces;
• other competent law enforcement agencies;
• regulatory or public authorities where legally appropriate;
• professional advisers where necessary to protect our legal interests.

We will not publish reports received through this service.

Information will only be shared where there is a legitimate reason or legal basis to do so.

Anonymous Reports

You may submit a report anonymously.

However, anonymous reports may limit our ability to:

• clarify information;
• request further evidence;
• provide updates.

Automated Decision Making

We do not use automated decision-making or profiling when assessing reports submitted through this website.

All reports are subject to human review.

Data Security

We use appropriate technical and organisational measures to protect information submitted through this service.

These measures include secure transmission, restricted staff access, audit logging and other appropriate security controls.

How Long We Keep Information

Reports will only be retained for as long as necessary for the purposes for which they were collected.

As a general guide:

• reports not requiring referral will normally be retained for 12 months before secure deletion;
• reports referred to public authorities may be retained for longer where necessary for legal, regulatory or evidential purposes.

Retention periods may be extended where required by law or ongoing legal proceedings.

Your Rights

Depending upon the circumstances, you may have the right to:

• request access to your personal information;
• request correction of inaccurate information;
• request erasure where appropriate;
• request restriction of processing;
• object to processing;
• lodge a complaint with the Information Commissioner's Office (ICO).

Certain rights may be restricted where providing information would prejudice the prevention or detection of crime, law enforcement activities or the rights and freedoms of others.

Information About Other People

If you provide information about another individual, please ensure that it is relevant to your report and provided honestly and in good faith.

Do not include unnecessary personal information.

Evidence Uploads

If you upload photographs, videos or documents, you confirm that:

• they were obtained lawfully;
• you are entitled to provide them;
• they have not been altered in a misleading manner;
• they are relevant to the report being made.

Please do not place yourself or others at risk in order to obtain evidence.
